This paper offers a critical examination of two recent American Supreme Court verdicts, Masterpiece Cake Shop v Colorado Civil Rights Commission and Trump v Hawaii. In Masterpiece the Court ruled against the state of Colorado on grounds that religious bias on the part of state officials undermines government’s authority to enforce a policy that might otherwise be constitutional. In Trump the Court ruled in favor of an executive order severely restricting immigration from seven countries, five of which are Muslim majority. (...) Both verdicts raise important issues concerning fairness and religious freedom. After examining some of the central legal issues in these verdicts I offer a critical assessment of the legal arguments, focusing on how political value judgments played a crucial role in determining the legal outcomes. In the United States, Protestant Christian identity is the dominant religious identity. Protestant Christian identity confers status privileges, yet also creates objectionable status inequalities. Historical and contemporary evidence includes the unfair treatment of Mormons, Native Americans, Muslims, and other religious minorities. Protestant Christian supremacy also plays a significant role in bolstering anti LGBTQ prejudice, xenophobia, and white supremacy. Ways that Protestant Christian identity correlates with objectionable status inequalities are often neglected in contemporary political philosophy. This paper aims to make a (...) modest contribution towards filling that gap. Some forms of inequality linked to Protestant Christian supremacy can be characterized as domination and oppression. Other instances include barriers to fair equality of opportunity for self-determination. Adapting ideas from egalitarian political philosophy I propose an analysis of objectionable status inequality rooted in Protestant Christian supremacy. Alan Patten’s defense of an egalitarian principle for assessing the effects of law and policy is helpful for this task. (shrink)

In this paper I propose an approach to thinking about religion and politics that should inform how we think about liberalism and religion. I also consider how the conception of political authority defended by the prominent Muslim public intellectual Abdullahi Ahmed An-Na’im is a paradigm example of liberalism. In Part I I consider two approaches to religion and politics. According to the reductionist view, whether values that are central to a religious tradition can be reconciled to liberalism is more a (...) matter of doctrine than practice. By contrast a non-reductionist approach emphasizes that the relationship between political and religious values is influenced by a number of variables in addition to religious doctrine, including ethnicity, historical memory, political economy, and local politics. On this view, the path between religious and political convictions is anything but a straight line. In Part II I examine central arguments in An-Na’im’s work that are central to his version of liberalism, with a focus on liberty of conscience and religious freedom. To illustrate An-Na’im’s liberalism I focus on examples of claims about morality and theology, politics, and history. I conclude in Part III by considering how An-Na’im’s position is one example of what we would expect from a non-reductionist understanding of religion and politics. (shrink)

Alfred Stepan’s “twin-tolerations” thesis (2000) is a model for explaining different ways that religious and political authority come to be reconciled. In this paper, we investigate some obstacles and challenges to realizing a reconciliation between religious and political authority in the Kingdom of Saudi Arabia (KSA) that might result in a transition away from a theocratic monarchy to a more consultative form of political authority. Whereas most analyses of religion and politics in KSA focus on geopolitics, the rentier state model, (...) or economic and military aid from the United States, we also consider local factors that emphasize the agency of political and non-political actors within KSA, focusing in particular on education policy and how this policy is a barrier to political reform. Our position is not meant to replace the standard models, but rather to supplement them by offering a multi-variable perspective on the challenges and prospects for meaningful political reform in KSA. Holm (2022) argues that a class of algorithmic fairness measures, that he refers to as the ‘performance parity criteria’, can be understood as applications of John Broome’s Fairness Principle. We argue that the performance parity criteria cannot be read this way. This is because in the relevant context, the Fairness Principle requires the equalization of actual individuals’ individual-level chances of obtaining some good (such as an accurate prediction from a predictive system), but the performance parity criteria do not guarantee any (...) such thing: the measures merely ensure that certain population-level ratios hold. This study evaluated the citizens’ assessment ofthe delivery of environmental management programs of the Local Government Unit (LGU) of Banga, Aklan employing the CitizenSatisfaction Index System (CSIS). Particularly, the study determined the awareness, availment, satisfaction,and need for action on the LGU’s environmental management programs. The study applied a mix of quantitative and qualitative methods. The samples were determined by applying the Multi-Stage Random Probability Sampling technique to give all the citizens an equal chance to be selected as a participant. The (...) 150 respondents were drawn from barangays with larger shares of the population. The qualified sample respondents were identified using the Kish Grid. All respondents were 18 years old and above. An odd-numbered questionnaire was administered to male respondents while an even-numbered questionnaire was targeted to female respondents. The reasons for their response were likewise gathered. The study concluded that most of the respondents were aware of the clean-up programs/projects. On the other hand, a low awareness was attained on projects such as air pollution control programs and solid waste management. A high percentage of respondents had availed of environmental management programs offered in the LGU. Overall, many respondents were happy with the local government unit's environmental management activities, indicating that less action is necessary. The LGU should improve its air pollution control and solid waste management initiatives, according to the recommendations. Appropriate measures must be used to persuade people to participate, particularly those who burn their trash. Seminars and courses on appropriate trash disposal are held and conduct of regular tree-planting activities may be carried out to help resolve this problem. (shrink)

Citizen Satisfaction Index System (CSIS) was used to assess the delivery of support to education initiatives in the municipality of Banga, Aklan, Philippines. The samples were determined using multiple application of stratified random sampling approach. In accordance with the Philippine Statistical Authority's Data on Census Population and Housing for 2015, barangays having a bigger share of the population contributed more respondents to the 150 targeted participants. Following the inclusion criteria, the probability respondents were chosen using the Kish Grid. Pre-numbered questionnaires (...) were distributed, with odd numbers targeting male responders and even numbers targeting females. The following criteria were used to evaluate the respondents' assessments: awareness, availment of the program/service, satisfaction, and need for action. Furthermore, interviews were conducted to better understand and investigate the respondents' thoughts, behavior, and perspectives. The reasons for their reaction were also obtained. The data was provided in percentage as well as frequency distributions. The study inferred that awareness on alternative learning system and/or special education program should be improved since it is the only program that attained low rating for awareness. Most of the residents were not able to avail education programs because they have no household member who attends school. Majority of the respondents who availed the services were satisfied. However, scholarship and other assistance programs to students may be enhanced to improve service delivery. It is highly recommended by the citizens to improve accessibility to scholarship programs and other forms of financial assistance to students. (shrink)

Interview was also conducted to gather reasons for their ratings. The study inferred that majority of the respondents were highly aware of the community-based greening project. However, low awareness was attained on projects such as air pollution control program and waste-water management. A high percentage of respondents have availed the environmental management programs except for solid waste management. Overall, majority of the respondents were satisfied of the environmental management programs rendered by the local government unit and therefore needs less action. It is recommended that the local government unit strengthen air pollution control program. (shrink)

Shun Kwong-loi argues that the distinction between first- and third-person points of view does not play as explanatory a role in our moral psychology as has been supposed by contemporary philosophical discussions. He draws insightfully from the Confucian tradition to better elucidate our everyday experiences of moral emotions, arguing that it offers an alternative and more faithful perspective on our experiences of anger and compassion. However, unlike the distinction between first- and third-person points of view, Shun’s descriptions of anger and (...) compassion leave unarticulated what would be necessary to differentiate these responses from non-moral responses. Here, I make a friendly suggestion on how this explanatory gap might be filled, providing complementary grounding for Shun’s observations by way of K. C. Bhattacharyya’s phenomenological analysis of feeling. It fills the gap by means of a gradation in the possible depth of emotional responses found in the a priori structure of a feeling experience for any subject. The payoff of such a comparison between Shun’s explication of Confucian moral psychology and Bhattacharyya’s explication of rasa theory is not only a possible phenomenological grounding for the former but also a potential way to articulate a missing ethics in Bhattacharyya’s thought. Peter Fitzpatrick’s writings prove once and for all that it is possible for a law professor to write in beautiful English. His work also proves once and for all that the dominating tradition of Anglo-American legal philosophy and of law teaching has been barking up the wrong tree: namely, that the philosopher and professional law teachers can understand justice as nested in empty forms, better known as rules, doctrines, principles, policies, and other standards. The more rigorous our analysis or decomposition (...) of the forms, we have believed, the more closely do we access the identity of laws. Justice has been assumed to be a matter of intellectually accessing such analysed forms. Fitzpatrick’s articles and books embody an implicit critique of the analytic view of law and of justice. My entry point into this critique is his preoccupation with Jacques Derrida’s theory of laws as universals and with Derrida’s theory of justice as an inaccessible immediacy or presence in context-specific or concrete experienced events. Each event is experienced in an official’s decision. Such a decision represents what Derrida, Fitzpatrick, and Hegel call ‘individuality’. -/- Derrida’s theory of law presents a conundrum. Derrida misses the possibility that law may exist by virtue of its content rather than its form. Derrida misses this possibility because, heavily influenced by Kant (in Derrida’s theory of law), Derrida associates law with universals. This is so because Kant (and Derrida) are preoccupied with the identity of what counts as a law (lois) rather than with a law’s legitimacy. A universal cannot exist unless it is legitimate, and it is legitimate, I claim, by virtue of its content. In his association of law with universals, Derrida presupposes that legal knowledge exists with reference to a territorial-like boundary. The forms are represented or signified by signs (signifiers) within a boundary of the ultimate form (the state, the nation, or humanity). This ultimate form as a universal, like the discrete rules or forms, lacks socially contingent content. A boundary separates knowable universals from the unknowable world on the exteriority of the boundary. The unknowable world is constituted by concrete events experienced in context-specific circumstances. In his legal theory Derrida hones in upon the decision as the experienced event. In a decision, one is present or immediate with the event. Derrida considers such immediacy as justice. The immediacy, however, can only be represented as a sign (sometimes called a signifier). The sign, in turn, represents an empty signified or form, according to Derrida. Because the immediacy remains a representation rather than a presentation of the experienced event, laws as universals cannot be just. The rupture between the inaccessible immediacy of a decision on the one hand and the represented empty forms on the other is critical to Derrida’s theory of law. -/- I claim that this rupture permeates Derrida’s writings about law because Derrida possesses a territorial-like sense of legal knowledge. I shall argue to this effect as follows. In the first section I shall explain the importance of Fitzpatrick’s exposure of the vacuity of the foundation of the system or structure of universals. In the second section I shall flesh out two elements of Derrida’s legal theory: law as form and the ipseity or concrete event that the form excludes from law. This takes me to the third section, where I shall elaborate how Derrida’s legal theory presupposes knowledge as territorial. I shall argue in the final section that this very sense of territorial knowledge prevents justice from accessing law and law from accessing justice. I conclude with the hint of a very different sense of law, one that draws from experiential knowledge in contradistinction to territorial knowledge. (shrink)

The main purpose of the thesis is to identify and fill some gaps that are regularly found in the analysis of the Platonic concept of ἐξαίφνης. The word ἐξαίφνης, which appears 36 times in the Platonic dialogues, has primarily been examined and discussed in relation to what is said in Parmenides and, more rarely, in Symposium, Republic and Seventh Letter. However, as is known, the word is also found in Gorgias, Cratylus, Theaetetus, Statesman and Laws. Moreover, it is worth noting (...) that a history of criticism about the concept of ἐξαίφνης has never been provided, mainly due to the chronological and interpretive difficulties relating to Parmenides. This absence brought on a fragmentation and discontinuity in the study of the concept and it often prompted specialists to see in this notion a secondary or imprecise aspect of the Platonic theory. Regardless of the correctness of interpretations that have been proposed over the centuries, my work clearly shows that all these exegeses share two fundamental limits: the former is a necessarily partial analysis, almost exclusively based on what is written in Parmenides, the latter is the absence of a historical perspective . Cette thèse portant sur le concept d’ἐξαίφνης tel qu’on le trouve dans les textes de Platon se propose de combler les lacunes existantes relatives à l’analyse de ce concept. En effet, le terme d’ἐξαίφνης, dont on trouve trente-six occurrences dans les dialogues de Platon n’a été jusqu’à présent principalement envisagé et examiné qu’à travers ce qui en est dit dans le Parménide et, plus rarement, dans le Banquet, la République et la Lettre VII. Le terme, comme on le sait, se trouve pourtant aussi dans le Gorgias, le Cratyle, le Théétète, le Politique et les Lois. En outre, en raison notamment des difficultés chronologiques et interprétatives liées au dialogue du Parménide, aucune histoire critique du concept d’ἐξαίφνης n’a été entreprise. Cette absence d’histoire critique a pour effet une fragmentation et une discontinuité des études portant sur ce concept, effets qui ont souvent conduit les spécialistes à ne voir dans cette notion qu’un aspect secondaire ou à tout le moins imprécis de la théorie que développe Platon à son sujet. Aussi la thèse s’est-elle attachée à entreprendre une étude préalable de l’histoire de ces interprétations. Quelle que soit la justesse et la valeur des interprétations qui se sont succédées au cours des siècles, cette étude s’emploie à montrer clairement que ces tendances exégétiques se heurtent à deux limites fondamentales que la thèse s’applique à lever : la première est le caractère nécessairement partiel d’une analyse menée presque exclusivement à partir du Parménide, la seconde est l’absence de mise en perspective historique. [Commentary on Kwong-loi Shun, “Anger, Compassion, and the Distinction between First and Third Person” Australasian Philosophical Review 6.1 (Issue theme: Moral psychology— Insights from Chinese Philosophy), forthcoming.] -/- In maintaining that gratitude fails to reflect a perspectival distinction based on whether the grateful agent is the direct beneficiary of the benefactor’s good will, Kwong-loi Shun suggests that gratitude might be felt to benefactors for benefits bestowed to strangers. With an eye toward understanding the form that gratitude might take on this (...) kind of view, I consider two mutually exclusive ways of unpacking this proposal in the context of Shun’s other commitments. On the first (expansive) approach, responses of grateful reciprocation are extended to persons who presently receive only our approval or approbation. The expansive route, however, entails treating gratitude and its negative counterpart asymmetrically, for reasons that are nonobvious. On the second (restrictive) approach, gratitude in effect collapses into approval, and our interpersonal practices are rid not only of angry payback (of the sort associated with resentment), but also of the 'positive payback' presently associated with gratitude. The restrictive route, however, excises from our practices features of gratitude that have considerable interpersonal value. (shrink)

The 'substitution argument' purports to demonstrate the falsity of Russellian accounts of belief-ascription by observing that, e.g., these two sentences: (LC) Lois believes that Clark can fly. (LS) Lois believes that Superman can fly. could have different truth-values. But what is the basis for that claim? It seems widely to be supposed, especially by Russellians, that it is simply an 'intuition', one that could then be 'explained away'. And this supposition plays an especially important role in Jennifer Saul's (...) defense of Russellianism, based upon the existence of an allegedly similar contrast between these two sentences: (PC) Superman is more popular than Clark. (PS) Superman is more popular than Superman. The latter contrast looks pragmatic. But then, Saul asks, why shouldn't we then say the same about the former? The answer to this question is that the two cases simply are not similar. In the case of (PC) and (PS), we have only the facts that these strike us differently, and that people will sometimes say things like (PC), whereas they will never say things like (PS). By contrast, there is an argument to be given that (LS) can be true even if (LC) is false, and this argument does not appeal to anyone's 'intuitions'. The main goal of the paper is to present such a version of the substitution argument, building upon the treatment of the Fregan argument against Russellian accounts of belief itself in "Solving Frege's Puzzle". A subsidiary goal is to contribute to the growing literature arguing that 'intuitions' simply do not play the sort of role in philosophical inquiry that so-called 'experimental philosophers' have supposed they do. Consider the sentence “Lois knows that Superman flies, but she doesn’t know that Clark flies”. In this paper we defend a Millian contextualist semantics for propositional attitude ascriptions, according to which ordinary uses of this sentence are true but involve a mid-sentence shift in context. Absent any constraints on the relevant parameters of context sensitivity, such a semantics would be untenable: it would undermine the good standing of systematic theorizing about the propositional attitudes, trivializing many of the central questions (...) of epistemology, the philosophy of mind, and the philosophy of action. In response to this problem, we prove a series of tenability results. We show that, given certain constraints on the parameters of context sensitivity, there is a broad class of principles of propositional attitude psychology whose good standing follows from corresponding claims about people’s mental representations. But these constraints also have some surprising consequences: they are jointly incompatible with coarse-grained theories of propositions, and they are in tension with a natural picture of how speakers and hearers coordinate on the interpretation of attitude ascriptions. In light of these consequences we explore different ways in which the contextualist picture might be developed, and argue that our preferred way compares favorably with Fregeanism and neo-Russellianism. The aim of this paper is to argue in favor of the idea that it is possible not only to give a special place to reason in our life and in society, but also to offer an integrative rational framework, in in which human ends and goals find their rational expression. The text has three parts. The first describes Alfred Schutz's practical-hermeneutical approach to law and normativity, while making room for a subjective practice of reason. The second proposes to reveal, (...) through the description of knowledge in the world of ordinary life, a form of rationality which offers us practical but consistent ways of making a decision. Ultimately, the third aims at the practical-hermeneutical reconstruction of the law, in order to integrate into the core of legal reasoning references to ends and purposes without prejudicing the objectivity of the reasoning itself. The study aims to make a contribution to the problem of dedifferentiation and positivism of practice in the modern world. Le but de ce papier est d’argumenter en la faveur de l’idée qu’il est possible non seulement de donner une place particulière à la raison dans notre vie et dans la société, mais aussi d’offrir un cadre rationnel intégratif, dans lequel les fins et buts humains trouvent leur expression rationnelle. Le texte comporte trois parties. La première décrit l’approche pratique-herméneutique d’Alfred Schutz à l’égard de la loi et de la normativité, tout en faisant place à une pratique subjective de la raison. La deuxième se propose de dévoiler, à travers la description de la connaissance dans le monde de la vie ordinaire, une forme de rationalité qui nous offre des voies pratiques mais consistantes de prendre une décision. En fin de compte, la troisième vise la reconstruction pratique-herméneutique de la loi, afin d’intégrer dans le noyau du raisonnement légal des références à des fins et buts sans porter préjudice à l’objectivité du raisonnement lui-même. These days the two most popular approaches to belief ascription are Millianism and Contextualism. The former approach is inconsistent with the existence of ordinary Frege cases, such as Lois believing that Superman flies while failing to believe that Clark Kent flies. The Millian holds that the only truth-conditionally relevant aspect of a proper name is its referent or extension. Contextualism, as I will define it for the purposes of this essay, includes all theories according to which ascriptions of the (...) form ‘S believes that a is F’ and ‘S believes that b is F’, where ‘a’ and ‘b’ are coreferential proper names, may, depending on the context, differ in truth-value even though in those very contexts each ascription relates the same believer to the very same proposition. What the two theories have in common is the claim that names are Millian. What separates the two theories is what they say about belief contexts. In this essay I prove that Millianism is true, Contextualism is true, or our intuitions regarding belief ascriptions are hopelessly inaccurate. As a consequence, my argument is a proof that either names and many general terms are Millian or our intuitions regarding belief ascriptions are hopelessly inaccurate. (shrink)

Je montre comment le concept de « l’oppression de genre » s’est naturalisé au voile musulman d’une telle manière qu’il justifie les normes de féminités occidentales et cache le mécanisme par lequel les femmes musulmanes (...) sont racialisées. C’est ainsi que le voile devient le point de mire d’un racisme culturel qui se présente comme libérant les femmes musulmanes, un racisme qui semble poser un dilemme au féminisme. -/- // ABSTRACT: This paper examines two French contexts in which Muslim veils have become hypervisible as centres of contention: the public debate that led to the recent French law banning conspicuous religious signs in public schools and the French colonial project to unveil Algerian women. I ask how the concept of gender oppression comes to be naturalized to the Muslim veil in such a way as to simultaneously justify Western norms of femininity and hide the process by which Muslim women are racialized. It is in this way, I argue, that the “veil” becomes the focal point for a form of cultural racism that presents itself as saving Muslim women, and that it can be construed to pose a dilemma to feminism. In this short article, my aim is to introduce readers to some debates about religious freedom and constitutional law in the United States. I highlight a few of the enduring questions debated by political philosophers and legal scholars. For example, does the Constitution require special religious exemptions for citizens whose religious convictions put them at odds with otherwise neutral and legitimate state pol- icy? Should the Constitution be interpreted as supporting a strict secularism or a multicultural egalitarian liberal position? What (...) are the limits to religious freedom? To illustrate how these and related questions are debated I consider some recent work on religious freedom jurisprudence in the United States. (shrink)

Les solutions étaient bien sûr extrêmement diverses : Spinoza niera même que l’on puisse (...) faire la distinction entre principe créateur et création, tandis que d’autres, tel Robert Boyle, s’imagineront un maître horloger créant une machine absolument parfaite, qui depuis sa création ne requiert aucun acte supplémentaire de la part de son créateur. Jusque dans la pensée du jeune Kant, cette idée se rencontrera sous des formes diverses. Tous convenaient, tout de même, qu’il fallait rejeter l’ancien modèle aristotélicien d’une nature désirante, reconstruisant la nature comme un système reposant sur quelques lois fondamentales et repensant à nouveaux frais le rôle que Dieu peut, ou doit, jouer dans un tel système. Les contributions du présent volume traitent d’aspects historiques et systématiques des théories modernes de la nature et du surnaturel, tout en essayant de comprendre, dans ce contexte, l’importance des théories de la relation entre Dieu et le monde. Le respect de la vie privée et de l’intimité est un droit reconnu aux usagers des services de santé et des services sociaux par différents codes d’éthique, par la Charte des droits et libertés de la personne du Québec et par la Loi sur les services de santé et les services sociaux. Pour autant, la signification que prend ce droit demeure incertaine. Il n’y a pas une signification, mais bien des significations. S’appuyant sur un important travail d’observation dans deux comités (...) d’éthique clinique situés dans des établissements de santé et de services sociaux, les auteurs présentent et analysent ici un certain nombre de situations litigieuses dans lesquelles une interprétation du droit à la vie privée et à l’intimité a été faite. Au terme de l’exercice, il ressort entre autres que, selon les situations analysées, les discussions qui se font dans les CÉC conduisent à des modalités différentes (« déplacement et hiérarchisation », « opposition et évitement », « ouverture et compromis », « élargissement et remise en question ») qui ont pour effet de changer le regard porté sur l’usager et plus spécifiquement de faire comprendre son point de vue. En outre, si le droit à la vie privée et à l’intimité contribue à modifier l’interprétation que l’on se fait d’une situation ou des usagers, il est lui-même objet d’interprétation. C’est la diversité de sens qu’il peut prendre qui lui préserve son pouvoir d’interroger. (shrink)

Elle marqua le début de la scolastique, fille du judaïsme élevée par des penseurs juifs, selon l'historien Heinrich Graetz (Geschichte der Juden, L. 6, Leipzig 1861, p. xii). Imprimée par la première presse mécanique de Gutenberg, son influence en Occident s'étendit jusqu'au Vème concile du (...) Latran (1512-1517) « où les savants furent encouragés à lever les difficultés qui semblaient diviser l'ensemble de la théologie et de la philosophie — (Leibniz, Théodicée, 11 ) ». Résumé Le débat holisme-réductionnisme se structure autour de trois domaines sémantiques : l 'ontologie, la méthodologie et l'épistémologie. Généralement, une méthodologie analytique s'accompagne d'une ontologie atomiste et de la réduction des lois et théorie des niveaux d'organisation supérieurs aux lois et théorie des niveaux inférieurs. Par contre, une ontologie holiste, relationnelle peut s'accorder au concept d'émergence. En conséquence dans l'élaboration des lois et théories d'un phénomène appartenant à un niveau donné la prise en compte du niveau d'organisation (...) supérieurs se révélera déterminante. Les propositions philosophiques anti-mécanicistes de précurseur tels que Bradley, S. Alexander, A.N. Whitehead, C.L. Morgan, D.C. Broad, même en restant au niveau d'une forme de proto-émergentisme représentent le fondement épistémologique à partir duquel s'est développée une méthodologie véritablement émergentiste. Abstract The holism-reductionism debate is structured around three areas of semantics: ontology, methodology and epistemology. As a general rule, an analytical methodology goes with an atomist ontology, and the reduction of laws and theories from the higher levels of organisation to the laws and theories of lower levels. On the other hand, a holistic and relational ontology can be in unison with the concept of emergence. As a consequence, in elaborating laws and theories of a phenornenon of a given level, taking into account that the higher level of organisation will be determinant. The philosophical and anti-mechanistic propositions of precursors such as F. Bradley, S. Alexander, A.N. Whitehead, C.L. Morgan, D.C. Broad, even remaining at the level of a kind of proto-emergentism represent the epistemological basis on which a true emergentist methodology has been developed. (shrink)

J’ai lu de nombreuses discussions récentes sur les limites du calcul et de l’univers en tant qu’ordinateur, dans l’espoir de trouver quelques commentaires sur le travail étonnant du physicien polymathe et théoricien de la décision David Wolpert, mais n’ont pas trouvé une seule citation et je présente donc ce résumé très bref. Wolpert s’est avéré quelques théoricaux d’impossibilité ou d’incomplétude renversants (1992 à 2008-voir arxiv dot org) sur les limites de l’inférence (computation) qui sont si généraux qu’ils sont indépendants de (...) l’appareil faisant le calcul, et même indépendamment des lois de la physique, ainsi ils s’appliquent à travers les ordinateurs, la physique, et le comportement humain. Ils utilisent la diagonalisation de Cantor, le paradoxe menteur et les worldlines (lignes du monde) pour fournir ce qui peut être le théorème ultime dans Turing Machine Theory, et apparemment fournir des aperçus de l’impossibilité, l’incomplétude, les limites du calcul, et l’univers comme ordinateur, dans tous les univers possibles et tous les êtres ou mécanismes possibles, générant, entre autres, un principe d’incertitude mécanique non quantique et une preuve de monothéisme. Il existe des connexions évidentes à l’œuvre classique de Chaitin, Solomonoff, Komolgarov et Wittgenstein et à l’idée qu’aucun programme (et donc aucun dispositif) ne peut générer une séquence (ou un dispositif) avec une plus grande complexité qu’il ne possède. On pourrait dire que cet ensemble de travaux implique l’athéisme puisqu’il ne peut y avoir d’entité plus complexe que l’univers physique et du point de vue wittgensteinien, « plus complexe » n’a aucun sens (n’a pas de conditions de satisfaction, c’est-à-dire véridique ou test). Même un « Dieu » (c’est-à-dire un « dispositif » avec un temps/ espace et une énergie illimité) ne peut pas déterminer si un « nombre » donné est « aléatoire», ni trouver un certain moyen de montrer qu’une « formule » donnée, un « théorème » ou une « phrase » ou un « dispositif » (tous ces jeux de langage complexes) fait partie d’un « système » particulier. Tác giả Schneider-Mayerson tìm tòi trong địa hạt “climate fiction”—tức là thể loại văn học không giấu chủ đích nhằm vào nội dung trực diện đối với vấn nạn khủng hoảng khí hậu—đang bùng nổ về số lượng tác phẩm trong thập niên đầu thế kỷ 21. Thường thì nghe qua phần đông cho rằng thể loại tác phẩm này sẽ có tác động sinh thái-chính trị tích cực thông qua trang bị cơ sở thông tin cho độc giả nhận biết tương lai khí hậu và thuyết phục về mức độ ảnh hưởng khẩn cấp của biến đổi khí hậu. Dans cet article, il sera fait un bref rappel du modèle traditionnel d’interprétation des lois, toujours prescrit dans la doctrine, sinon épousé verbalement dans les tribunaux canadiens. Il sera démontré que ce modèle ne peut pas représenter toute la réalité du travail d’interprétation des juristes canadiens, pour plusieurs raisons. L’herméneutique, la sociologie critique, l’analyse du discours, prenant pour objet les textes législatifs, les jugements rendus, les arguments pratiques entendus, ont montré l’étendue du comportement réflexif réel, l’étendue du champ interprétatif (...) visant les circonstances d’une cause. Les textes législatifs donnent de fait de plus en plus de place à l’interprétation des circonstances pertinentes à l’encadrement de l’action des justiciables. Sur un plan empirique, l’analyse des jugements, de même que les prises de position de juges lorsqu’ils s’expriment en dehors du forum judiciaire, mettent en évidence la variété des motifs effectivement pris en considération, l’espace considérable de délibération éthique impliquant de fait tous les interprètes, qu’ils soient simples citoyens d’une communauté, inspirés par l’un ou l’autre des ordres sociaux, ou acteurs spécialisés de l’ordre juridique. Cet article se propose d’examiner comment se produit actuellement, en droit canadien ou québécois, l’interprétation des juristes, dans des processus décisionnels réflexifs, en situations complexes, voire même dans la perspective du développement des institutions. Political liberty is at the centre of liberal conceptions of toleration. Liberal political philosophers disagree about the limits of toleration, whether equality is central to liberal toleration, and the toleration of illiberal religious and cultural practices, among other topics. Some non-liberal states adopt a model of toleration, despite significant limitations on liberty. Moreover, some recent work in comparative philosophy emphasizes pluralism across traditions of political morality. This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. Recent epidemiological reports of associations between socioeconomic status and epigenetic markers that predict vulnerability to diseases are bringing to light substantial biological effects of social inequalities. Here, we start the discussion of the moral consequences of these findings. We firstly highlight their explanatory importance in the context of the research program on the Developmental Origins of Health and Disease (DOHaD) and the social determinants of health. In the second section, we review some theories of the moral status of health inequalities. (...) Rather than a complete outline of the debate, we single out those theories that rest on the principle of equality of opportunity and analyze the consequences of DOHaD and epigenetics for these particular conceptions of justice. We argue that DOHaD and epigenetics reshape the conceptual distinction between natural and acquired traits on which these theories rely and might provide important policy tools to tackle unjust distributions of health. This chapter examines some central features to liberal conceptions of toleration and liberty of conscience. The first section briefly examines conceptions of toleration and liberty of conscience in the traditions of Locke, Rawls, and Mill. The second section considers contemporary controversies surrounding toleration and liberty of conscience with a focus on neutrality and equality. The third section examines several challenges, including whether non-religious values should be afforded the same degree of accommodation as religious values, whether liberty of conscience requires a (...) secular state, and how bias impedes understandings of toleration and liberty of conscience. The chapter concludes with brief comments on future directions for research on toleration and liberty of conscience. One is exploring toleration and liberty of conscience in non-Western contexts; another is exploring ways that varieties of religious and political identity impact conceptions of toleration and liberty of conscience. Objective: Evidence suggests people experience an oral size illusion and commonly perceive oral size inaccurately; however, the nature of the illusion remains unclear. The objectives of the present study were to confirm the presence of an oral size illusion, determine the magnitude (amount) and direction (underestimation or overestimation) of the illusion, and determine whether immediately prior crossmodal perceptual experiences affected the magnitude and direction. Design: Participants (N = 27) orally assessed 9 sizes of stainless steel spheres (1/16 in to 1/2 (...) in) categorized as small, medium, or big, and matched them with digital and visual reference sets. Each participant completed 20 matching tasks in 3 assessments. For control assessments, 6 oral spheres were matched with reference sets of same-sized spheres. For primer-control assessments, similar to control, 6 matching tasks were preceded by cross-modal experiences of the same-sized sphere. For experimental assessments, 8 matching tasks were preceded by a cross-modal experience of a differently sized sphere. Results: For control assessments, small and medium spheres were consistently underestimated, and big spheres were consistently overestimated. For experimental assessments, magnitude and direction of the oral size illusion varied according to the size of the sphere used in the cross-modal experience. Conclusion: Results seemed to confirm an oral size illusion, but direction of the illusion depended on the size of the object. Immediately prior cross-modal experiences influenced magnitude and direction of the illusion, suggesting that aspects of oral perceptual experience are dependent upon factors outside of oral perceptual anatomy and the properties of the oral stimulus. In the first chapter of his Knowledge and Lotteries, John Hawthorne argues that thinkers do not ordinarily know lottery propositions. His arguments depend on claims about the intimate connections between knowledge and assertion, epistemic possibility, practical reasoning, and theoretical reasoning. In this paper, we cast doubt on the proposed connections. We also put forward an alternative picture of belief and reasoning. In particular, we argue that assertion is governed by a Gricean constraint that makes no reference to knowledge, and that (...) practical reasoning has more to do with rational degrees of belief than with states of knowledge. Accurate statistical analysis of Fortnite gameplay data is essential for improving gaming strategies and performance. In this study, we present a novel approach to analyze Fortnite statistics using machine learning techniques. Our dataset comprises a wide range of gameplay metrics, including eliminations, assists, revives, accuracy, hits, headshots, distance traveled, materials gathered, materials used, damage taken, damage to players, damage to structures, and more. We collected this dataset to gain insights into Fortnite player performance and strategies. The proposed model employs advanced (...) machine learning algorithms and data preprocessing techniques. We aim to identify key performance indicators and influential factors that contribute to Fortnite success. By exploring patterns and relationships within the dataset, our model can provide valuable insights into gameplay optimization. Our research involves feature analysis to determine the most influential factors in predicting Fortnite performance. These factors include eliminations, assists, revives, accuracy, hits, headshots, distance traveled, materials gathered, materials used, damage taken, damage to players, damage to structures, and more. By understanding the impact of these factors, we aim to help Fortnite players enhance their skills and strategies. Through extensive training and validation of our machine learning model, we achieved remarkable results, with an accuracy rate of [Your Accuracy Rate]% and an average error of [Your Average Error]. Increasing evidence from psychology and neuroscience suggests that emotion plays an important and sometimes critical role in moral judgment and moral behavior. At the same time, there is increasing psychological and neuroscientific evidence that brain regions critical in emotional and moral capacity are impaired in psychopaths. We ask how the criminal law should accommodate these two streams of research, in light of a new normative and legal account of the criminal responsibility of psychopaths.

Does the idea of justice make sense only in the human world? Can it make sense also in the world of non-human animals? Put another way, is there scope for justice in the animal world, or is it simply a “might is right” world? Starting from recent research of ethologists, philosophers, psychologists, and jurists, we will reflect on the hypothesis of the existence of an “animal justice” through the identification of three possible contexts of justice in the animal world (distributive (...) justice, ludic fairness, retributive justice) and the analysis of a famous experiment on justice among monkeys. This research allows us to explore the axiological dimension of the hypothetical deontic world of non human animals. (shrink)

This paper argues that it is prudentially wise to defer to groups about how they are essentially constituted and defined. After a few words situating the paper in my greater research project (§1), I articulate the kind of deference I have in mind (§2). Then I offer two conditional arguments on why it is epistemically desirable to let other people tell you how they ought to be identified (§3). The first argument is that people are owed lexical sovereignty because denying (...) it is absurd; the second is that modest skeptics ought to agree with it on the basis of some relatively anodyne and plausible epistemic considerations. Abstract: Colon cancer is a prevalent and life-threatening disease, necessitating accurate and timely diagnosis for effective treatment and improved patient outcomes. This research paper presents the development of a knowledge-based system for diagnosing colon cancer using the CLIPS language. Knowledge-based systems offer the potential to assist healthcare professionals in making informed diagnoses by leveraging expert knowledge and reasoning mechanisms. The methodology involves acquiring and structuring medical knowledge specific to colon cancer, followed by the implementation of a knowledge- based system using (...) CLIPS. The system's design integrates relevant medical databases and employs advanced reasoning mechanisms to facilitate accurate diagnosis. Evaluation results demonstrate the system's effectiveness, with high accuracy and sensitivity rates compared to existing methods. The findings highlight the potential of knowledge-based systems in improving clinical practice and patient care. The research contributes to the growing field of medical informatics by demonstrating the feasibility and effectiveness of CLIPS-based knowledge systems for colon cancer diagnosis. Future research can focus on enhancing system performance and expanding its scope to encompass other types of cancer diagnoses. (shrink)
